PART C — Terms, Rules & Declarations

C1. Participation at Own Risk

The rider participates in this activity entirely at their own risk. Quad biking is a high-risk adventure activity involving uneven terrain, unforeseen obstacles, and mechanical risk. Mad Max Quads accepts no liability for personal injuries, death, loss, or damage to personal property (including phones, cameras, glasses, and clothing) sustained during the tour, except where liability cannot be excluded under the laws of the Republic of Serbia.

C2. Financial Liability for Vehicle Damage

The rider bears full financial responsibility for all damage to the vehicle, equipment, or third-party property caused during the tour as a result of: rule violations, failure to follow guide instructions, vehicle rollover, alcohol or drug use, or gross negligence. Damage is assessed immediately after the tour and payment must be settled before leaving the premises.

Fees are approximate. Final amount is based on actual repair or replacement cost at current market prices for original CFMOTO parts plus labour at authorised service rates.

C3. Waiver of Claims against Mad Max Quads

The rider waives all future claims, lawsuits, or demands for compensation against Mad Max Quads, Dragan Živković, and their employees, to the extent permitted under the laws of the Republic of Serbia. This waiver does not apply to cases of gross negligence or intentional harm on the part of the service provider.

C4. Alcohol & Drug Prohibition — Zero Tolerance

Riding under the influence of alcohol, drugs, or any intoxicants is strictly prohibited. If the guide suspects a rider is under the influence, the tour is terminated immediately with no refund obligation.

C5. Weight Limit & Equipment Rules

Maximum combined capacity per quad is 150 kg. Mad Max Quads reserves the right to refuse service if this limit is exceeded. Wearing a full-face helmet and gloves is mandatory for the entire tour duration. Refusal to wear safety equipment results in immediate tour cancellation without refund.

C6. No Driver Swaps & No Overtaking

Only the registered rider named in this agreement may operate the quad. No other person may take control of the vehicle. Overtaking the guide or deviating from the designated route is strictly prohibited and will result in immediate tour termination without refund.

C7. Medical Fitness & Exclusions

The rider declares they are in good physical and mental health and not aware of any condition that would make participation unsafe. This activity is NOT suitable for:

  • Pregnant persons
  • Persons with serious back or neck injuries
  • Persons with severe heart conditions or epilepsy
  • Persons experiencing vertigo or severe motion sickness
  • Persons under the influence of alcohol, drugs, or coordination-affecting medication

Mad Max Quads reserves the right to refuse participation to any person who appears physically or mentally unfit on the day of the tour, without obligation to issue a refund.

C8. Photography, Video & Marketing

Photographs and video recordings taken during the tour may be used as evidence in the event of a dispute or damage claim, regardless of marketing consent.

Marketing consent (separate, optional):

YES — I freely consent for Mad Max Quads to use photographs and video in which I appear for marketing purposes (Instagram, Facebook, TikTok, website). I may withdraw this consent in writing to bookings@madmaxquads.rs.

NO — I do not consent to marketing use of my image.

C9. Data Protection — PDPA No. 87/2018

Mad Max Quads collects personal data (name, ID/passport number, phone, driver’s licence number) solely for administering this agreement, safety record-keeping, and legal compliance, in accordance with Serbia’s Personal Data Protection Act (PDPA No. 87/2018 / Sl. glasnik RS br. 87/2018). Data is not shared with third parties without consent except where required by law. You have the right to access, rectify, or request erasure of your data at any time by contacting bookings@madmaxquads.rs.

C10. Cancellation Policy & 15-Minute Rule

  • 48+ hours notice: full refund or free reschedule
  • 24–48 hours notice: 50% refund
  • Under 24 hours or no-show: no refund
  • Arriving more than 15 minutes late is treated as a no-show — no refund will be issued

Under Article 37 of Serbia's Law on Consumer Protection, recreational services booked for a specific date are exempt from the standard 14-day withdrawal right.

C11. Weather Policy

Tours run in light rain — we provide ponchos. Cancellation is only offered when conditions are genuinely unsafe (severe storms, flooding, extreme heat, dangerous winds). If we cancel: full refund or free reschedule. You will be contacted no later than 3 hours before departure.

C12. Complaints Procedure

Any complaints must be submitted in writing to bookings@madmaxquads.rs within 8 days of the tour date. We will respond within 8 days of receipt, as required by Serbian Law on Consumer Protection. If unsatisfied, you have the right to contact the relevant Serbian authority (poverenik.rs).

  1. I have read, fully understood, and voluntarily agree to all terms of this Master Agreement & Liability Waiver. I acknowledge that quad biking involves inherent risks and that I participate of my own free will.
  2. I confirm I am physically fit for this activity and am NOT under the influence of alcohol or drugs. I declare that none of the above medical exclusion conditions apply to me.
  3. I understand and accept the Cancellation Policy, including that I have paid the full tour fee and there is no refund entitlement for cancellations within 24 hours or no-shows.

About Us

Scope

These Terms & Conditions apply exclusively to guided quad bike tours operated by Mad Max Quads. We do not offer vehicle hire, self-drive hire, or family/junior sessions.

These Terms & Conditions govern all bookings, tours, and services provided by Mad Max Quads, operated by Dragan Zivkovic, based in Bela Crkva, Vojvodina, Republic of Serbia.

By completing a booking with Mad Max Quads — whether online, by phone, or in person — you confirm that you have read, understood, and agree to be bound by these Terms & Conditions in full.

02 — BOOKING & PAYMENT

Booking & Payment

Bookings can be made via our website, by phone, or by email. A booking is only confirmed once full payment has been received.

Payment

Full payment is required at the time of booking to secure your place on a tour. We accept online card payment via OTP Bank E-Commerce. Prices are listed on our website and are subject to seasonal change without notice.

Upon confirmed payment you will receive a booking confirmation. Please bring this confirmation — along with your valid driver's licence — on the day of your tour.

Mad Max Quads reserves the right to limit the number of participants per tour for safety reasons.

03 — CANCELLATION & REFUNDS

Cancellation & Refund Policy

We understand that plans change. Our cancellation policy is as follows:

Full refund
More than 48 hours notice

Cancel more than 48 hours before your scheduled tour and receive a full refund (100%) or a free reschedule.

Partial refund — 50%
24 to 48 hours notice

Cancellations made between 24 and 48 hours before the tour are eligible for a 50% refund.

No refund
Under 24 hours, no-show, or 15+ minutes late

Cancellations within 24 hours of the tour start time, no-shows, and arrivals more than 15 minutes late are non-refundable. The full amount paid is forfeited. Under Article 37 of Serbia's Law on Consumer Protection, recreational services booked for a specific date are exempt from the standard 14-day withdrawal right.

All refund requests must be submitted in writing to bookings@madmaxquads.rs. Approved refunds are issued to the original card via OTP Banka and typically appear within 3–5 business days depending on your bank or card provider.

04 — ELIGIBILITY

Eligibility & Requirements

Mandatory Requirement

All riders must hold a valid Driver's Licence — Category B or F. This is a legal requirement under Serbian law for the operation of quad vehicles. No exceptions will be made. Failure to produce a valid licence on the day will result in cancellation of your tour without refund.

05 — TOUR RULES

Tour Rules

All participants agree to follow the rules below for the duration of the tour. Breach of any rule may result in immediate termination of the tour without refund.

  • No overtaking the guide. The guide leads the route at all times. Overtaking is strictly prohibited.
  • No driver swaps. Only the registered and licenced rider may operate the quad at any time.
  • No alcohol or drugs. Riding under the influence of alcohol, drugs, or any intoxicant is strictly forbidden and will result in immediate tour cancellation without refund.
  • Safety equipment must be worn. Helmet (with full face shield) and gloves must be worn for the entire duration of the tour.
  • Weight limit: 150 kg combined per quad. This is a safety limit and cannot be exceeded under any circumstances.
  • Follow all guide instructions. The guide's decisions regarding route, pace, and safety are final.
  • Vehicle condition. Riders accept the quad in good technical condition at the start and are responsible for any damage caused through negligence or rule violations.
06 — LIABILITY & RISK

Liability & Risk

Quad riding is an outdoor adventure activity that involves inherent risks, including but not limited to uneven terrain, mechanical issues, and collision. By booking a tour, you acknowledge and accept these risks.

Mad Max Quads and Dragan Zivkovic accept no liability for any personal injury, death, loss, or damage to property sustained by the rider or any passenger during a tour, except where such liability cannot be excluded by Serbian law.

The rider bears full financial responsibility for all damage caused to the quad vehicle, equipment, or third-party property — particularly where such damage results from a violation of these Terms, alcohol or drug use, gross negligence, or reckless behaviour.

Photographic and video evidence recorded during tours may be used in the event of a damage claim or legal dispute.

A refundable security deposit may be collected on the day of the tour at the operator's discretion. The deposit is returned in full upon safe return of the vehicle and equipment.

The damage fees below are indicative. The final amount is based on the actual repair or replacement cost assessed at the time of the incident, and is payable before leaving the premises.

07 — MEDICAL & FITNESS

Medical Fitness

All riders and passengers must be in a suitable physical and mental condition to participate safely in a quad tour.

Health Declaration

By booking, you confirm that you are not aware of any medical condition, disability, illness, injury, or impairment that would make participation in this activity unsafe or inadvisable. If in doubt, please consult a medical professional before booking.

Mad Max Quads is not responsible for any injury, illness, or adverse health event arising from or aggravated by any pre-existing or undisclosed medical condition. This includes but is not limited to: heart conditions, epilepsy, vertigo, musculoskeletal injuries, pregnancy, or any condition affected by physical exertion, vibration, or uneven terrain.

Mad Max Quads reserves the right to refuse participation to any person who appears unfit, unwell, or impaired on the day of the tour, without obligation to issue a refund.

08 — EQUIPMENT & VEHICLES

Equipment & Vehicles

All quad vehicles are maintained to a safe operating standard before each tour. Safety equipment — including full-face-shield helmets and gloves — is provided at no additional cost.

Riders accept the vehicle in good technical condition at the commencement of the tour. Any pre-existing damage must be reported to the guide before departure.

Damage to vehicles or equipment caused by rider negligence, reckless behaviour, or violation of tour rules will be charged to the rider at the cost of repair or replacement.

09 — WEATHER & OUR CANCELLATIONS

Weather & Cancellation by Mad Max Quads

Outdoor tours are subject to weather and terrain conditions. Mad Max Quads reserves the right to cancel or reschedule a tour where conditions are deemed unsafe — including but not limited to severe rain, flooding, extreme heat, or dangerous wind.

If We Cancel

Where Mad Max Quads cancels a tour due to weather or circumstances beyond our control, you will be offered the choice of a full refund or a reschedule to a date of your choice. The decision is entirely yours.

We will contact you as early as possible — and no later than 3 hours before the scheduled tour start — if a cancellation is necessary. We recommend providing a local or roaming phone number when booking.

10 — PHOTOS & VIDEO

Photography & Video

Mad Max Quads may record photographs and video footage during tours for safety documentation purposes. Use of this material for marketing — including social media (Instagram, Facebook, TikTok) and our website — requires your explicit opt-in consent, which is collected via the on-site Rental Agreement & Waiver form signed on the day.

Declining marketing consent does not affect your ability to participate in a tour. You may withdraw your marketing consent at any time by written request to bookings@madmaxquads.rs.

Safety and evidence footage may be retained regardless of marketing consent, for use in the event of a dispute, damage claim, or legal proceeding.

11 — PRIVACY

Privacy & Personal Data

Mad Max Quads collects and processes personal data (including name, contact details, and identification information) in accordance with Serbia's Personal Data Protection Act (PDPA No. 87/2018).

Your data is used solely for the purposes of administering your booking, fulfilling legal and safety obligations, and — where you have explicitly consented — marketing activities.

12 — RIGHT TO REFUSE

Right to Refuse Service

Mad Max Quads reserves the right to refuse participation to any person, or to terminate a tour early, where a participant:

Grounds for refusal or termination
Is unable to produce a valid Category B or F driver's licence
Appears to be under the influence of alcohol, drugs, or any intoxicant
Appears physically or mentally unfit to participate safely
Exceeds the 150 kg combined weight limit per quad
Refuses to wear mandatory safety equipment
Refuses to follow guide instructions or engages in reckless behaviour
Behaves in an aggressive, abusive, or threatening manner toward the guide or other participants

Where a tour is terminated early or refused for any of the above reasons, no refund will be issued.

13 — COMPLAINTS PROCEDURE

Complaints Procedure

Any complaint relating to your tour must be submitted in writing to bookings@madmaxquads.rs within 8 days of the tour date.

We will respond to any formal complaint within 8 days of receipt, in accordance with the Serbian Law on Consumer Protection.

If you remain dissatisfied with our response, you have the right to contact the Commissioner for Information of Public Importance and Personal Data Protection (poverenik.rs).

14 — GOVERNING LAW

Governing Law & Disputes

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Serbia.

Any dispute arising out of or in connection with these Terms — including any question regarding their existence, validity, or termination — shall be subject to the exclusive jurisdiction of the competent courts of Pančevo, Serbia (the court of jurisdiction for Bela Crkva / South Banat District).

Mad Max Quads reserves the right to amend these Terms & Conditions at any time. The version in effect at the time of your booking shall apply to your tour.

16 — CARD ACCEPTANCE

Payment Card Acceptance

We accept all validly presented payment cards: MasterCard, Maestro, Visa, and DinaCard. All types of valid payment cards and payment methods are treated equally, without favouring or marginalising specific card brands or payment methods.

17 — CURRENCY CONVERSION

Currency Conversion Statement

All payments are processed in the local currency of the Republic of Serbia — the Serbian dinar (RSD). Indicative prices in other currencies use the National Bank of Serbia mid-market rate. The amount charged to your payment card will be expressed in your local currency through conversion at the rate used by the card schemes — which we cannot know at the moment of the transaction. As a result of this conversion there may be a small difference between the original price shown on our site and the amount on your card statement.

18 — SERVICE DELIVERY

During the purchase process, the customer receives confirmation of service delivery via e-mail.

19 — TRANSACTION SECURITY

Protection of Confidential Transaction Data

When entering payment card details, confidential information is transmitted over the public network in protected (encrypted) form. At no moment are payment card details accessible to our system.

20 — REFUND MECHANISM

Refund Mechanism

In the case of return of goods and refund to a customer who has previously paid with one of the payment cards, in part or in full, regardless of the reason for return, Mad Max Quads is obliged to issue the refund exclusively via VISA, EC/MC, Maestro, and Dinacard payment methods — meaning that the bank, at the merchant’s request, will return the funds to the payment card account.

21 — VAT STATUS

Dragan Živković PR Mad Max Quads is not registered in the VAT system.

22 — RIGHT OF WITHDRAWAL

Right of Unilateral Contract Termination

The customer has the right to withdraw from a distance contract within 14 days, without stating a reason. Please note that this right does not apply to services fully performed before the withdrawal period expires.

Protection of User Privacy

On behalf of MAD MAX QUADS, we undertake to safeguard the privacy of all our customers. We collect only the data necessary for our business and for the provision of a quality service, and we process it in a lawful and transparent manner. Collected data include personal data such as first name, surname, e-mail address, telephone number and address, as well as technical data such as IP addresses and cookies that enable the website to function optimally. Collected data are used to process bookings, deliver services, send promotional notices, and for analysis and improvement of the user experience. All customer data are kept strictly confidential and accessible only to employees who need it to do their job. The data are processed on the basis of consent, to fulfil legal obligations, or on the basis of the merchant’s legitimate interests. The customer may at any time withdraw consent for marketing, unsubscribe from mailing lists, or refuse to participate in marketing campaigns. Customers have the right to access, correct, delete, or transfer their data, and to restrict processing. All MAD MAX QUADS employees (and business partners) are responsible for upholding privacy principles.

25 — COMPLAINTS

Complaints Policy

The customer has the right to file a complaint within 2 years from the day of purchase of the service.

  • How to file a complaint In writing to e-mail hello@madmaxquads.rs or by telephone on +381 64 1442818.
  • Response deadline The merchant will respond within 8 days from receipt at the latest.
  • Resolution deadline The complaint will be resolved within 14 days at the latest.
  • Costs If the complaint is justified, the merchant bears the return costs. If it is unjustified, the costs are borne by the customer.
  • Service-specific If the service provided does not match what was booked, contact us within 24 hours of execution.
